Ohio Vax-a-Million Official Rules

From Tuesday, May 18, 2021 through June 20, 2021 at 11:59:59 p.m. EDT (the “Promotional Period”), Eligible Ohioans may enter Ohio Vax-A-Million (“Promotion”).

The drawings will be conducted weekly, for five (5) weeks, beginning on May 24, 2021.

There will be two (2) drawings each week. One (1) for Ohioans ages 12 to 17 years and one (1) drawing for Ohioans ages 18 and over. Entrants will be placed in a drawing pool based on their birthdate.

The winners will be announced and posted on the ohiovaxamillion.com website after the announcement in accordance with the following drawing announcement schedule:

Entry must be completed through www.ohiovaxamillion.com by June 20, 2021 at 11:59:59 EDT to participate in at least one of the drawings.

By successfully transmitting a completed online entry form, with the appropriate information as directed, each participant will be entered into the Promotion.

If you do not have access to the internet, you may call the Ohio Department of Health (“ODH”) call center, which is open seven (7) days a week from 9 a.m. to 8 p.m. EDT and can be reached at 1-833-4-ASK-ODH (1-833-427-5634). You must provide the requisite information and request that you be entered into the drawing. Entries must be received by June 20, 2021 at 11:59:59 p.m. EDT, to be eligible to participate in at least one of the drawings.

One entry per person. Eligible Ohioans can only submit one (1) entry into the drawings. Prior to the drawings being held the entry list will be reviewed, and all duplicate entries removed.

All entries received will be included in all drawings for Vax-a-Million after the entry is received unless you win. All winners will be removed from future drawings.

All information submitted online by entrants is subject to, and will be treated in a manner consistent with, the State of Ohio’s Privacy Policy, which is currently accessible at: https://ohio.gov/wps/portal/gov/site/help-center/privacy-notice-and-policies.

Eligibility and Verification

You are eligible to participate in the drawing if you meet all the following requirements:

  1. You are a living citizen of the United States and a permanent resident of the State of Ohio.
  2. You are at least 12 years of age.
  3. You are not incarcerated (in prison or jail) for a felony conviction under the laws of this state, another state, or the United States.
  4. You are not an employee or Officer of the Ohio Lottery Commission, the Ohio Department of Health or the Ohio Governor’s Office, or any blood relative or spouse of such an employee or officer living as a member of the employee’s or officer’s household.
  5. You have received at least your first dose of COVID-19 vaccine if receiving the Pfizer or Moderna vaccine or one dose if receiving the Johnson & Johnson vaccine.

All winner information and eligibility will be reviewed prior to the declaration of an Official Winner. Potential winners’ information will be validated by State of Ohio officials.

In the event that an entry is deemed invalid, a discrepancy is found, or the winner cannot be located based upon the contact information submitted, an alternate shall be used in place of the ineligible or un-locatable winner.

In the event that the winner does not wish to receive a prize, refuses or fails to provide verification information, or does not promptly respond to the initial contact by State of Ohio officials, that winner may be deemed ineligible and an alternate may be used. If it is determined that an alternate will be used, the winner that was deemed invalid will forfeit any prizes associated with the Promotion.

The promptness and degree of reasonableness of efforts to locate a winner or of any decision to deem a winner ineligible based upon these rules shall be at the sole discretion of the State of Ohio.

Alternates will be used in the order in which they were selected (i.e. alternate one (1) will be used first, alternate two (2) second and so on) as vacated spots become available.

Any information registered for or by a minor child or an adult under a guardianship must be validated by a parent or legal guardian prior to award of a prize. The entry form for Ohioans ages 12 to 17 years old must include a parent or legal guardian’s information, including their name, address, phone number and email address.

By entering the drawing, the Ohio Department of Health has been explicitly authorized to access vaccination records to verify that a COVID-19 vaccination has been received. The COVID-19 vaccination is not required to be obtained in the State of Ohio, however, proof and verification of vaccination, to the satisfaction of the State of Ohio, is still required. For Ohioans receiving either the Pfizer or Moderna vaccines, at least the first COVID-19 vaccination must be obtained prior to the entry deadline. Ohioans ages 12 and over who participated or are currently participating in a clinical trial for other COVID-19 vaccines are also eligible.

Verification of all information must be presented to claim any prize.

Internet Conduct and Limitations of Liability

Any attempt by a user, participant or any other individual to deliberately damage the promotion website or undermine the legitimate operation of this Promotion, is a violation of criminal and civil laws, and should such an attempt be made, the State of Ohio reserves the right to seek the prosecution of and/or damages from any such person or persons as permitted by law. Furthermore, such person may be excluded from the Promotion.

Neither the State of Ohio, nor the Governor of the State of Ohio, the Lieutenant Governor, any of its employees, commissioners, owners, directors, officers, affiliates, subsidiaries, contractors, assignees and agents are responsible for late, or incomplete or misdirected entries, or responsible for incorrect or inaccurate information, whether caused by the website, or by any of the equipment or programming associated with or utilized in this Promotion.

Neither the State of Ohio, nor the Governor of the State of Ohio, the Lieutenant Governor, any of its employees, commissioners, owners, directors, officers, affiliates, subsidiaries, contractors, assignees and agents are responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Promotion, which may include without limitation, inaccessibility or unavailability of the internet, the website or any combination thereof; theft or destruction or unauthorized access of the website; any injury or damage to the participants or to any other person’s computer(s) or smartphone related to or resulting from participating in this Promotion, or downloading materials from or use of the website.

Random Drawing and Results

The winners of the drawings will be randomly selected from among all eligible entries received.

Subject to verification of eligibility and compliance with these Official Rules, the potential winners drawn and verified will be declared the official winners of the Ohio Vax-a-Million drawings.

Prizes

Ohio Vax-A-Million Drawing – Ohioans Age 18 and Over
One(1) – $1 million per drawing

Ohio Vax-A-Million Drawing – Ohioans Ages 12 to 17
One (1) full scholarship to an Ohio state college or university per drawing. The scholarship funds are in the amount of the qualifying expenses for in-state tuition, books, and room-and-board for a four-year program, two-year program, community college program, or technical or trade school. The scholarship funds are available until the winner reaches the age of 28, after which any remaining funds available in the scholarship are forfeited. The award of the scholarship does not include any guarantee or assurance of entry or acceptance into any college or university.

General Rules

All prize details shall be determined in the sole and absolute discretion of the State of Ohio. Ohioans who do not meet the eligibility requirements defined in these official rules are not eligible to win.

For the drawing for Ohioans ages 18 and over, the winner will be responsible for any taxes associated with this prize. Federal, State and Local taxes are the sole responsibility of the applicable drawing winners. An IRS Form 1099 will be issued by the State of Ohio to each applicable winner. All federal, state and local laws, applicable taxes, and regulations apply.

For the drawing for Ohioans ages 12 to 17, the funds will be distributed per agreement by and between the Ohio Department of Health and the Ohio Tuition Trust Authority, known as the Ohio CollegeAdvantage Direct 529 Savings Plan (the “Plan”). The Plan will accept the funds and place them into a scholarship account on behalf of all five (5) winners. The Plan will manage the funds for the recipients as beneficiaries. As structured, the scholarship account to be used for qualified tuition and related expenses does not incur tax liability to the beneficiaries, based upon current federal tax law, which is subject to change. However, expenses associated with housing and dining costs (room and board) may be taxable income to the beneficiary, based upon current federal tax law, which is subject to change. Those expenses, if applicable, will be transferred at an appropriate time to a separate account or program on behalf of the beneficiary, during such times as the beneficiary remains a full time student. Winners will be notified of the specifics of each program and its accompanying terms and conditions by the Plan.

The drawing prize may be reduced by monies owed to the Ohio Department of Job and Family Services, the Ohio Department of Taxation and/or or the Attorney General’s Office, if applicable.

Acceptance of the prize constitutes express permission for the State of Ohio and its agencies as set forth in the Release and Verification to use the prize winner’s name and/or likeness worldwide, in perpetuity, for purposes of advertising and trade without further compensation, notification or permission unless prohibited by law, in any and all media now known or hereafter devised. Further, by accepting a prize, each prize winner agrees to hold the State of Ohio, including its Governor, Lieutenant Governor, any of its employees, commissioners, owners, directors, officers, affiliates, subsidiaries, contractors, assignees and agents , absolutely harmless against any and all claims and/or liability arising out of the ownership and/or use of a prize. Each prize winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in the Promotion or use or redemption of any prize. The State of Ohio makes no warranty, guarantee or representation of any kind concerning any prize (or any portion thereof) and disclaims any implied warranty. By participating in the Promotion, all entrants agree to be bound by these Official Rules.

All materials submitted become the property of the State of Ohio and will not be returned. Prizes are nontransferable to any other person, including relatives or friends. Fulfillment of the prize will occur approximately six (6) weeks after the announcement date, with the exception of the scholarship winners for whom fulfillment occurs at the time of enrollment at an Ohio state college or university for a four-year program, two-year program, community college program, or technical or trade school.

The Ohio Vax-a-Million Official Rules and Drawing Procedures used by the Lottery are available for review and may be amended or revised at any time at the sole discretion of the Executive Director of the Lottery and the Director of the Department of Health. The drawings will be observed by representatives of the Auditor of State.

The State of Ohio, at its discretion, reserves the right to select and/or change the prize(s) to be awarded as part of this Promotion or end the Promotion prior to all prize winners being drawn.
