Take Care of Business Sweepstakes Official Rules

NO PURCHASE OR VACCINATION NECESSARY. A PURCHASE OR VACCINATION WILL NOT INCREASE YOUR CHANCES OF WINNING. BY ENTERING THE SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING.

1. Sweepstakes Timing: The Dallas Regional Chamber “Take Care of Business” Sweepstakes (the “Sweepstakes”) begins 9:00 a.m. Central Time (“CT”) on June 28, 2021 and ends at 11:59 p.m. CT on August 31, 2021 (the “Sweepstakes Period”). The Sweepstakes Period consists of two (2) Entry Periods (and Entries from the first Entry Period roll over into the second Entry Period), as follows: “Entry Period 1” begins 9:00 AM CT on June 28, 2021 and ends at 11:59 p.m. CT on July 23, 2021; and “Entry Period 2” begins at 12:00 a.m. CT on July 24, 2021 and ends at 11:59 PM CT on August 31, 2021 (each, an “Entry Period”).

2. Eligibility: The Sweepstakes is open only to legal United States residents residing in Dallas County, Collin County, Denton County, or Tarrant County in Texas, who are 18 years of age or older as of date of entry. Employees of Dallas Regional Chamber (the “Sponsor”), their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies, including Don Jagoda Associates, Inc. (the “Administrator”), and their immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each (whether related or not), are not eligible to participate or win. Void where prohibited by law. All federal, state, and local laws and regulations apply.

3. Entry Pools; Random Drawing; Odds: All eligible Vaccination Entries and/or Mail-In Entries, as defined below, will be entered into either (or both) the pool of Entries assigned to Entry Period 1 (“Pool 1”) and/or the pool of Entries assigned to Entry Period 2 (“Pool 2”), as outlined in Section 4 and 5 below. On or about July 30, 2021, twenty-one (21) potential Prize winners will be selected from Pool 1 Entries. On or about September 7, 2021, eighteen (18) potential Prize winners will be randomly selected from Pool 1 and Pool 2 Entries. Prizes will also be allocated to either Pool 1 or Pool 2, and assigned to those winners randomly selected from their respective pools. Drawings will be conducted by Adminsitrator who is an independent organization. Sponsor and Administrator’s decisions are final and binding on all matters relating to the Sweepstakes. Odds of winning a Prize are dependent upon the number of eligible Entries for each Pool’s drawing.

4. How to Enter: There are two (2) ways to enter, as follows:

  • TO ENTER VACCINATION/THE WEBSITE: Beginning on June 9, 2021, if you received either your first or second shot in the COVID-19 vaccine series (or your only shot for the Johnson & Johnson COVID-19 vaccine), you may then visit takecareofbusiness.dja.com (the “Website”) and complete the online entry form, including uploading a photo of your proof of vaccination, to receive one (1) entry (the “Vaccination Entry”)into the corresponding Pool’s random drawing, as well as the subsequent Pool’s random drawing (if applicable), as described below. Limit one (1) Vaccination Entry per person.
  • TO ENTER VIA MAIL (ALSO THE METHOD OF ENTRY AVAILBLE FOR INDIVIDUALS WHO ARE NOT VACCINATED): You may also enter the Sweepstakes by hand printing your first and last name, full address, date of birth, phone number (including area code) and email address on one 3” x 5” piece of paper and mailing it in an envelope with proper first class postage affixed to: Dallas Regional Chamber “Take Care of Business” Sweepstakes, P.O. Box 7763, Melville, NY 11775-7763 (“Mail-In Entry”). This method of entry is available to both vaccinated and non-vaccinated individuals. You will receive one (1) entry into the corresponding Pool’s random drawing as well as the subsequent Pool’s random drawing (if applicable) based on the postmark date on the Mail-In Entry for each qualifying Mail-In Entry you submit in accordance with these instructions. Limit one (1) Mail-In Entry per hand-addressed stamped envelope. Otherwise, there are no limits to the number of Mail-In Entries an individual may submit. All Mail-In Entries must be handwritten and Mail-In Entries must be postmarked by July 23, 2021 and received by July 30, 2021 to receive an Entry into the Pool 1 and Pool 2 random drawing. All Mail-In Entries must be handwritten and Mail-In Entries must be postmarked by August 31, 2021 and received by September 7, 2021 to receive an Entry into the Pool 2 random drawing. All Mail-In Entries become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due Mail-In Entries, which will be disqualified.Vaccination Entries and Mail-In Entries will be collectively referred to as “Entries”. Use of any automated or computer system to participate online is prohibited and will result in disqualification. Normal Internet/phone access and data/usage charges imposed by your online/phone service may apply. Entries will not be acknowledged or returned.

5. Prizes and Approximate Retail Value (“ARV”):

Each of the above is a “Prize” and together, the “Prizes.” Limit one (1) Prize per person. All Prizes are Sponsor-specified. No transfer, substitution or cash equivalent for Prize will be permitted, except at the sole discretion of the Sponsor. Terms and conditions apply for airline Prizes/certificates, including blackout dates. In the event a Prize should be unavailable, an alternate Prize/Prize component of equal value will be selected by Sponsor in its discretion and awarded and the Sponsor’s obligation to the winner will be fulfilled. Game/concert/match/passes prizes must be used on date specified or prize may be forfeited. Seat assignments are Sponsor-specified. Sponsor is not responsible for cancelled or rescheduled events. All tickets and passes are subject to each respective ticket and pass terms. Transportation to/from any game/concert/match/event not included with prize. Sizes are Sponsor-specified. Acceptance of Prize constitutes permission for the Sponsor and its agencies to use winners’ names and/or likenesses for purposes of advertising and trade without further compensation, unless prohibited by law. Any and all applicable federal, state, and local taxes (including but not limited to income and sales taxes) and all fees, expenses, service charges, gratuities, and other costs related to acceptance and use of any Prizes not specifically stated herein are the sole responsibility of the individual Prize winner. An IRS form 1099 will be issued in each winner’s name if required by law. Only the stated number of prizes will be awarded. All Prizes consist solely of what is stated in the Prize description. ALL PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).

6. General Rules: Potential winners will be required to complete a Declaration of Eligibility, Release of Liability and a Publicity Release (where legal) within forty-eight (48) hours of notification attempt or else Prize will be forfeited and an alternate Prize winner may be selected. Failure to reach Prize winner within this timeframe or return of Prize notification as undeliverable may result in disqualification and an alternate winner may be selected (up to three alternates for each Prize may be notified). By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and Administrator. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Entries become the property of the Sponsor.The Sponsor and their agencies and Administrator are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Website or the Sweepstakes or by any human error which may occur in the processing of the Entries in the Sweepstakes or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the Website or Sweepstakes. In the event of a dispute as to any online Entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor, and/or Administrator (as identified in these Official Rules) are not responsible for the failure of any email or Entry to be received by Sponsor/Administrator on account of technical problems or congestion on the internet or at any website. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or Website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to undermine the legitimate operation of the Sweepstakes or Website may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes or Website, then the Sponsor reserves the right at its sole discretion to cancel the Sweepstakes and select the winners at random from among all eligible Entries received/postmarked for each Pool prior to cancellation. By entering the Sweepstakes, you hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents.

7. Release and Limitations of Liability: By participating in the Sweepstakes, the entrant agrees that Sponsor, Administrator, and each of their respective parents, subsidiaries, affiliated companies, agents, retailers, advertising and Sweepstakes agencies, and all of their respective shareholders, officers, directors, employees and assigns, members, representatives and agents (the “Released Parties”), will have no liability whatsoever for, and will be held harmless by entrant for any liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property, damages sustained due in whole or in part, directly or indirectly, from entering the Sweepstakes, or from the acceptance, possession, use or misuse of the Prize or parts thereof, if applicable, or participation in the Sweepstakes or participation in any Sweepstakes-related activity.By entering the Sweepstakes, each entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any Prizes awarded, will be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and by entering each entrant waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses.

8. Governing Law, Jurisdiction and Venue: SPONSOR IS REGISTERED UNDER THE LAWS OF THE UNITED STATES WITH HEADQUARTERS IN TEXAS. THE TEXAS COURTS (STATE & FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF TEXAS SHALL GOVERN THE SAME. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND HEREBY IRREVOCABLY SUBMITS TO THE VENUE OF THOSE COURTS WITHIN TEXAS.

9. Entrants’ Personal Information: Information collected from entrants is subject to Sponsor’s Privacy Policy, located at https://www.dallaschamber.org/privacy-policy/.

10. Winners: For the names of the winners, available after October 1, 2021, send a self-addressed stamped envelope no later than October 15, 2021, to: Dallas Regional Chamber “Take Care of Business” Sweepstakes – Winners, 100 Marcus Drive (Dept. DE), Melville, NY 11747.
