What Is the Difference Between a Sweepstakes and a Contest?
A sweepstakes and a contest are legally distinct promotional structures. In a sweepstakes, winners are selected entirely by chance — a random drawing — making "No Purchase Necessary" and an Alternate Method of Entry (AMOE) legally mandatory to avoid illegal lottery classification. In a contest, winners are selected based on skill, merit, or creative judgment applied to each entry, such as scoring photos, essays, or videos against published criteria. Because skill determines the outcome, contests may permissibly require a purchase or entry fee in most jurisdictions — though the prize cannot consist solely of the entry fees collected. The Dominant Factor Doctrine governs this distinction: if skill is the dominant factor separating participants' outcomes, the promotion qualifies as a contest. Both sweepstakes and contests require Official Rules, prize disclosure, sponsor identification, and state registration in Florida, New York, and Rhode Island when prize values meet applicable thresholds.
